Angatu is not responsible for delays caused by carriers, customs, or unforeseen circumstances.
Once an order has been shipped, we cannot modify or cancel it.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. Angatu is not responsible for any direct, indirect, incidental, or consequential damages arising from the use or misuse of our products.
Our liability is limited to the purchase price of the product in question.

SECTION 16 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Angatu and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 17 - FORCE MAJEURE
Angatu shall not be held responsible for any delay or failure in performance due to events beyond our reasonable control, including but not limited to: Natural disasters (fires, floods, hurricanes, earthquakes), Supply chain disruptions (raw material shortages, shipping delays), Labor disputes, strikes, or governmental actions, Acts of war, civil unrest, cyberattacks, or power failures, Pandemics or other public health emergencies. In such cases, Angatu reserves the right to modify, delay, or cancel services and orders as necessary.

SECTION 18 - DISPUTE RESOLUTION, ARBITRATION, AND CLASS-ACTION WAIVER

18.1 Arbitration Agreement
Except where prohibited by law, you and Angatu agree to resolve any disputes through binding arbitration rather than in court. This includes disputes related to:

• Your use of Angatu’s products or website.
• Any claims based on contract, tort, negligence, or applicable consumer protection laws.

The arbitration will be conducted under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. Unless otherwise agreed, the arbitration shall take place in Miami, Florida but may proceed telephonically in the event the total amount of the claim does not exceed $2,500 U.S. dollars (if the claimant so chooses).

18.2 Class-Action & Jury Trial Waiver
By agreeing to arbitration, you waive the right to file or participate in class-action lawsuits against Angatu. All claims must be brought individually, not as part of a group or collective proceeding. The parties further agree that the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
You also waive your right to a jury trial. A neutral arbitrator will resolve disputes, and their decision will be final and binding.
If any portion of this arbitration clause is found to be unenforceable, the remaining terms shall still apply.

Separate and apart from the agreement to arbitrate set forth above, the parties hereby independently waive any right to bring or participate in any class action in any way related to, or arising from, this agreement. You acknowledge that this class action waiver is material and essential to the arbitration of any disputes between the parties and is nonseverable from the agreement to arbitrate claims. If any portion of this class action waiver is limited, voided, or cannot be enforced, then the parties’ agreement to arbitrate shall be null and void. YOU UNDERSTAND THAT BY AGREEING TO THIS ARBITRATION AGREEMENT, WHICH CONTAINS THIS CLASS ACTION WAIVER, YOU MAY ONLY BRING CLAIMS AGAINST ANGATU, ITS AGENTS, OFFICERS, SHAREHOLDERS, MEMBERS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, PREDECESSORS IN INTEREST, SUCCESSORS AND/OR ASSIGNS IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. IF YOU DO NOT AGREE TO THIS ARBITRATION AGREEMENT AND CLASS ACTION WAIVER, YOU MUST TELL US IN WRITING AND NOT USE OUR SERVICE.

18.3 STATUTE OF LIMITATIONS
You agree that regardless of any statute or law to the contrary, any claim or cause of action by you against Angatu arising from or relating to the use of the Service must be filed within one (1) year after such claim or cause of action arose or such claim or cause of action will be permanently barred. 
You agree that your Angatu account is non-transferable and all of your rights to your account terminate upon your death. No agency, partnership, joint venture, fiduciary or other special relationship or employment is created as a result of these Mobile Terms, and you may not make any representations on behalf of or bind Angatu. 

SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
